These Terms and Conditions govern all users of BAY37 and the www.bay37.co website. They must be agreed upon before any purchases can be made. If you do not agree with these terms, do not purchase from this site.

Intended Use

The products we offer are intended for laboratory research use only. In purchasing any of these items, the customer acknowledges that there are risks involved with handling, consumption, or distribution of these products. These chemicals are not intended to be used as food additives, drugs, cosmetics, household chemicals, or other inappropriate applications.

Regulatory Status

BAY37 is a chemical supplier. BAY37 is not a compounding pharmacy or chemical compounding facility as defined under Section 503A of the Federal Food, Drug, and Cosmetic Act. BAY37 is not an outsourcing facility as defined under Section 503B of the Federal Food, Drug, and Cosmetic Act. All products are sold for research, laboratory, or analytical purposes only, and are not for human consumption.

Customer Representations and Warranties

All customers represent and warrant that, through their own review and study, they are fully aware and knowledgeable about the following: (a) government regulations regarding the use of and exposure to all products; and (b) the health and safety hazards associated with the handling of the products they purchase.

BAY37 reserves the right to limit or deny sales of products to any unqualified individuals if we have reason to believe that misuse will occur.

Age Requirement

All customers must be at least 21 years of age to purchase our products. By purchasing from this site, you affirm that you meet this requirement.

Limitation of Liability

Under no circumstances shall BAY37 or any associated affiliates be liable for consequential damages, including but not limited to lost profits, lost savings, lost data, loss of use, or any other incidental or consequential damages arising out of the use, misuse, or inability to use any product sold on this website.

Indemnification

In direct consideration of approving the sale of any product to the purchaser, the purchaser agrees to indemnify and hold BAY37 and any associated affiliates harmless from all claims, expenses, losses, and liability of any kind arising out of the purchaser’s handling, possession, and/or use of the product, whether used alone or in combination with any other substance. Any sale will otherwise be denied.

Research Purposes Only

BAY37’s products are intended solely for laboratory research purposes and, unless otherwise stated, are not to be used for any other purposes, including but not limited to in vitro diagnostic use, in food, drugs, medical devices, or cosmetics for humans or animals, or for commercial purposes. The purchaser agrees that the products have not been sterilized or tested by BAY37 for safety or efficacy in food, drug, medical device, cosmetic, commercial, or any other use.

The purchaser expressly represents and warrants to BAY37 that the purchaser will properly test, use, manufacture, and market any products purchased from BAY37 in strict compliance with all applicable laws and regulations, now and hereinafter enacted.

The purchaser further warrants that any material produced with any product shall not be adulterated or misbranded within the meaning of the Federal Food, Drug, and Cosmetic Act and shall not be materials which may not, under Sections 404, 505, or 512 of the Act, be introduced into interstate commerce.

Non-Therapeutic Use

All products and services offered are for research purposes only. Under no circumstances shall or should any of these materials be used for therapeutic or diagnostic purposes. BAY37 and www.bay37.co are not liable for any damages that may be caused by negligence, abuse, or any other unforeseen matter.

Research Affiliation

The purchaser warrants that they are affiliated with a laboratory, institution, university, or other research-based facility which warrants the purchase and use of products sold by BAY37 for research purposes only. Furthermore, should anyone purchase from BAY37 without such affiliations, they may be committing a fraudulent act for which they could be held liable.

Order Screening and Refusal

All users of www.bay37.co are required to fully understand that any communication which leads us to believe that a product will be used in a manner other than that which it is intended may result in order cancellation and a refusal-to-sell record, which may be checked against future orders.

BAY37 reserves the right to perform due diligence screening upon the information provided to check for accuracy.

Chargebacks

Chargebacks initiated in bad faith will be treated as fraudulent and pursued to the full extent of the law. If there is an issue with your order, please contact us directly at bay37@proton.me before initiating a chargeback so we can resolve it.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict-of-law provisions.

Changes to These Terms

BAY37 may revise these Terms at any time without notice. By continuing to use the site after revisions are posted, you agree to the revised Terms.
